Matheu D. Nunn is a Shareholder of Einhorn, Barbarito, Frost, Botwinick, Nunn & Musmanno, P.C., where he chairs the firm’s Family Law Practice and chairs its General Appellate Practice. Mat has a wide array of experience representing individuals from all fields, including but not limited to: athletes, business owners, entertainers, executives, financial services, lawyers, physicians, police officers, and teachers—as well as the spouses of individuals in those fields. Mat also serves as an Arbitrator of family law matters.

Mat, a former county and municipal prosecutor, is an experienced litigator; he has tried jury and bench trials and has handled more than 80 Appellate Division and Supreme Court matters, including precedent-setting family law decisions in Cardali v. Cardali, 255 N.J. 85 (2023) (cohabitation); Bisbing v. Bisbing, 230 N.J. 309 (2017) (child relocation); Quinn v. Quinn, 225 N.J. 34 (2016) (cohabitation); In re J.E.V., 226 N.J. 90 (2016) (adoption); and Clark v. Clark, 429 N.J. Super. 61 (App. Div. 2012) (financial malfeasance). He has also handled precedential decisions in other subject matters, including Shorthand Reporting v. DOL, 478 N.J. Super. 13 (App. Div. 2024) (overreaching by Administrative Agency)(as Amicus); Facebook, Inc. v. State, 254 N.J. 329 (2023) (Fourth Amendment Privacy issues)(as Amicus); Lapsley v. Sparta Twp., 249 N.J. 427 (2022) (personal injury liability); and State v. Andrews, 243 N.J. 447 (2020) (Fourth Amendment Privacy issues)(as Amicus).

Mat is Certified by the New Jersey Supreme Court as a Matrimonial Attorney and is a Fellow of the American Academy of Matrimonial Lawyers (AAML). He also serves on the Family Law Executive Committee of the New Jersey State Bar Association (NJSBA) and is a Member of the NJSBA Amicus Committee, having previously served as its Vice-Chair for two terms.

Mat’s cases and activities in the Bar have earned him “Attorney of the Year” nominations by the Editorial Board of the New Jersey Law Journal in 2017, 2018, and 2024. He is also recognized by the “Best Lawyers” Publication (since 2018) and by the Super Lawyers Publication (since 2012).

Prior to joining Einhorn Barbarito, Mat clerked for the Morris County Assignment Judge, the Hon. B. Theodore Bozonelis, A.J.S.C. (ret.), and then at the Appellate Division for the Hon. Jack M. Sabatino, P.J.A.D.

In many cases, a trial court decision is not the end of litigation – it is just the beginning. In New Jersey, after a trial court judge renders a decision, either party has a right to file an appeal with the Appellate Division of New Jersey. Thereafter, on occasion, the seven Justices of our New Jersey Supreme Court may, either by choice or by constitutional mandate, review all or some of the issues presented to the Appellate Division.

The Firm’s Appellate Practice Group is currently chaired by Partner, Bonnie C. Frost, Esq., with the assistance of her co-chair, Partner, Matheu D. Nunn, Esq. The duo of Frost and Nunn regularly handle emergent and non-emergent matters before the Appellate Division and Supreme Court. Their efforts across a wide-range of subject matters have resulted in a number of recent precedent-setting decisions, including the landmark child relocation case of Bisbing v. Bisbing; a case of first-impression regarding cohabitation and termination of alimony in Quinn v. Quinn; a contested adoption case of first impression in In re Adoption of a Child by J.E.V.; and a case of first-impression involving a special needs person in J.B. v. W.B. Overall, the Firm’s Appellate Practice Group has prevailed in 19 cases that its attorneys initiated or handled before the New Jersey Supreme Court, including the noteworthy “firefighters’ rule” decision of Ruiz v. Mero and the Supreme Court’s decision in State v. Dispoto.

The members of the Appellate Practice Group also: serve as co-counsel on appeals with other lawyers; are active in writing and/or arguing in amicus efforts for both the New Jersey State Bar Association and the American Academy of Matrimonial Lawyers; and regularly lecture with Justices, judges, and practitioners regarding appellate and Supreme Court practice. Additionally, the attorneys in our Appellate Practice Group are skilled in handling appellate arbitration of issues previously tried by arbitrators.
