Derek Linkous leads BSP’s embedded appellate counsel practice. He works with trial teams in significant business disputes to sharpen legal arguments, preserve issues for review, and develop a strong record for potential appeal. Derek has handled matters in more than thirty states and has embedded with trial teams in matters from California to Texas and several jurisdictions in between, including cases involving aggregate damages demands exceeding $1 billion.

His appellate practice is equally substantial, serving as lead appellate counsel before the U.S. Courts of Appeals for the Fifth, Sixth, Eighth, Ninth, and Tenth Circuits and in state appellate courts in California, Michigan, and Ohio. He has handled a variety of issues on appeal, including constitutional rights, employment, and telecommunications. His broader litigation experience includes class actions, contract disputes, environmental matters, and product liability cases.

Derek is active in the appellate bar and regularly writes and speaks on issues involving appellate strategy, trial preservation, and the relationship between trial and appellate counsel. He serves as Co-Chair of the Eastern District of Michigan Bar Association’s Appellate Practice as well as its Trial Advocacy Program. His presentations have included programs on embedded appellate counsel, appellate advocacy, Sixth Circuit practice, and U.S. Supreme Court business cases.

Derek has received recognition from a number of legal publications, including Chambers USA, Benchmark Litigation, Michigan Lawyers Weekly, Crain’s Detroit Business, The Best Lawyers in America: Ones to Watch, and Michigan Super Lawyers. His recent honors include recognition in appellate law as well as commercial litigation and class action defense.

Before entering private practice, he was a law clerk on both the United States Court of Appeals for the Fifth Circuit and the United States Court of Appeals for the Sixth Circuit. He earned his J.D., magna cum laude, from Northwestern University School of Law, where he served as Senior Articles Editor of the Northwestern University Law Review and President of the Julius H. Miner Moot Court Competition. He received his B.A., cum laude, in Political Science, History, and Legal Studies from Northwestern University and is a member of both the Order of the Coif and Phi Beta Kappa.

BSP Law’s Critical Motions and Appeals team represents clients in state and federal appellate matters across the United States, while also supporting trial teams on issues that can shape the outcome of a case before an appeal is ever filed. The group includes former clerks from the U.S. Courts of Appeals for the Fifth, Sixth, and Seventh Circuits, as well as former federal district court clerks.

The team handles appellate briefing and strategy, including matters where BSP Law was not involved at trial. Its lawyers review complex records, identify and develop the strongest appellate issues, and translate technical or novel legal questions into clear and persuasive arguments for appellate courts. The practice also assists with critical trial-stage motions that may affect later appellate review, including Rule 702 challenges, motions in limine, dispositive motions, and post-verdict motions.

BSP Law also provides embedded appellate counsel within trial teams, helping shape briefing, preserve the record, and position cases for both trial success and potential appeal. Its lawyers take leading roles on expert challenges, jury instructions, verdict forms, directed-verdict motions, and other significant filings arising before and during trial.
