Larry is diligent and ensures that each client benefits from the legal and practical experience of the firm as a whole. Larry serves as the firm General Counsel, and his internal firm clients appreciate his judgment, candor, knowledge, and mentorship. Larry supports the firm’s lawyers by connecting the different practice areas of the firm to draw on the collective wisdom and experience of the entire firm. Larry utilizes these in-house counsel skills when advising clients outside the firm, so that he may provide them with the benefits of his experience in collaborative and multi-discipline problem-solving.
Larry’s appellate practice includes not only briefing and arguing cases, but also advising clients about dispute resolution opportunities for cases on appeal.
Larry’s experience includes:
- Briefing and arguing various commercial litigation cases before federal and state courts of appeal
- Consultation regarding legal ethics and rules of professional conduct
- Representation of national insurance companies, disability insurance companies, and financial institutions in class-action litigation
- Representation of state public entities in administrative proceedings
Throughout our history, Lewis Roca has had a reputation for appellate work of the highest caliber. Ten United States Supreme Court decisions on the merits – including the landmark cases of Miranda v. Arizona, 384 U.S. 436 (1966) and Bates & O’Steen v. State Bar of Arizona , 433 U.S. 350 (1977) – had Lewis Roca lawyers as lead counsel.
Lawyers currently at the firm have represented clients in over 750 appeals involving areas from tort to tax, constitutional to commercial. Most of those cases have been in the Ninth Circuit Court of Appeals, the Arizona Supreme Court, the Arizona Court of Appeals, and the Nevada Supreme Court, but we also regularly handle appeals in the courts of our neighboring states and other federal circuits.
The core of any appellate practice is representing clients during the briefing and argument of a case on appeal, and our lawyers do that in dozens of cases every year. But our appellate group’s work also includes service to our clients that begins long before the briefs are filed, as well as representation in more unusual appellate proceedings.
We regularly counsel clients and trial lawyers on the presentation of evidence and arguments to the trial court so that issues may be properly presented in future appeals. Our appellate lawyers assist with the briefing and argument of motions during and after trial, preparation and argument of jury instructions, and the preparation of proposed findings and conclusions to be entered by the court. We are even available to observe trial proceedings and provide on-site advice regarding preservation of the appellate record. After trial is complete, we provide a realistic, objective analysis of the likely success of a case on appeal and its strengths and weaknesses to counsel our clients as they decide whether to take an appeal, as well as to assist in the settlement process in appropriate cases.
One guiding principle has driven our success over the past century: an unwavering commitment to client service. With lawyers and legal professionals across nine offices throughout the western United States, Lewis Roca has the resources and agility to handle virtually any matter.
We understand the industries in which our clients work and their business objectives. Our advice encompasses corporate and commercial transactions, litigation and dispute resolution, intellectual property, government and regulatory issues, and more.
For decades, we have been at the forefront of legal change in intellectual property, business regulations, land use, technology, and civil rights. We’ve handled many high-profile matters in U.S. history, including Miranda v. Arizona, the United States Supreme Court case that had a significant impact on law enforcement around the world. Our alumni include presidential advisors, federal appellate judges, and renowned legal scholars.
Larry Kasten has a wealth of appellate experience, which includes acting on behalf of individuals before the Ninth Circuit Court. “A thoughtful lawyer with great analysis and insight. He is a strategic thinker with a capacity for perceiving strengths and weaknesses in a case and strengthening it accordingly.”
